If you are using a Debian like disto, only

# apt-get install mythtv

For Ubuntu, as a most popular "Debian like distro", it would be better to use:

# apt-get install mythbuntu-control-centre

Or... just use mythbuntu distro as it is

The "official" 2.6.38 kernel's driver has been appeared on the Downloads page,
