can i use v4l git release?

i have another tuner; af9013, which requires a very new v4l release.
if i install v4l from git, reboot, install TBS drivers, reboot, i see no TBS card being loaded when 'dmesg |grep cx23'. (its asif i havent installed the drivers at all)
if i remove v4l git release, and re-compile the TBS drivers, then the TBS card is detected fine.

this is quite obviously a v4l version issue.
is there a way to get around it?
